An 18-year-old Superior man made an initial appearance in Douglas County Circuit Court Thursday after he allegedly shot and killed a horse Monday in the town of Parkland.

Bryan James Hathaway is facing a felony charge of mistreatment of animals in connection with the shooting.

Hathaway is accused of shooting Bambrick, a 26-year-old Arabian horse owned by Brenda Egan. Egan had owned the horse since it was about 6 months old.

Initially, Hathaway told police he had accidentally shot the horse while target shooting in the area.

According to the criminal complaint, however, Hathaway told a Superior police detective that he shot the horse after he attempted to pet it and the horse bit at him. Hathaway told the detective the reason he shot the animal was because he "wanted to have sex with the horse," the complaint states.

Hathaway was scared off by a neighbor who heard the gunshot and walked in that direction.

Hathaway also is facing a felony charge of driving a motor vehicle without the owner's consent. He was driving that vehicle shortly before he saw and killed the horse.

Hathaway is being held in Douglas County Jail on a probation violation. He was given a year's probation in February after pleading guilty to a misdemeanor charge of negligent handling of a weapon. The charge stems from a November 2003 incident when Hathaway threatened a group of teenagers with a loaded rifle.

A $5,000 signature bond was ordered for his release on the animal cruelty charge. Because of the nature of the crime, Court Commissioner Paul Baxter ordered that Hathaway is not to have contact with any animals.

A separate $2,000 signature bond was ordered for taking the car without the owner's consent.

Hathaway's next appearance in court is Dec. 22

18-year-old Bryan James Hathaway of Superior, accused of killing a horse for sexual gratification, was sentenced Monday in Douglas County Circuit Court. Hathaway pleaded no contest to a felony animal mistreatment charge in connection with the Dec. 6 shooting of an Arabian horse owned by Brenda Egan of rural Superior.

Initially, Hathaway told police the shooting was an accident, the result of target shooting in the area. He later told a Superior police detective he shot the horse after he attempted to pet it and it bit at him.

Hathaway told the detective the reason he shot the horse was because he wanted to have sex with the animal, according to the criminal complaint.

A neighbor scared Hathaway off after hearing the gunshot and walking toward the shot.

Judge Michael Lucci found Hathaway guilty based on his plea and sentenced him to 18 months in prison and two years of extended supervision. In addition to the sentence, Lucci ordered Hathaway to undergo treatment for a psychosexual disorder and pay restitution to Egan.

Hathaway was also given six additional years' probation in connection with stealing the car used to get to rural Superior on Dec. 6.

Hathaway's sentences will run consecutively with a six-month jail sentenced handed down in January for a probation violation in an unrelated case. Hathaway was sentenced in January to six months in jail for threatening a group of teenagers with a loaded rifle in November 2003.
