Frank Aquino, 43, of Putnam County, is accused of viciously kicking his neighbor's elderly dog to death. Neighbors witnessed Roxi wander onto Aquino's property during a holiday cookout over memorial weekend.
Putnam Valley sheriffs stated witnesses saw Aquino walk up to the dog and kick it "football style" in the stomach.
Aquino has pleaded not guilty.
The court case has been adjourned until August 11th. If found guilty, Roxi's owners are hoping Aquino gets the maximum sentence of five years behind bars. A Putnam County man will spend the next 20 weekends in jail -- beginning January 13, 2006 -- for kicking a neighbor's dog to death last year.
Putnam County Town Justice Louis DiCarlo threw the book at Frank Aquino, 41. Frank Aquino was due in Putnam Valley Town Court at 9:30 a.m. to answer felony charges of animal cruelty, but the case was adjourned for a second time. Neighbors have said they saw the 40-year-old kick the dog like a football, and that the 45-pound mixed shepherd dog dragged herself under a tree and died.
The incident took place May 30 during a Memorial Day barbecue at Aquino's home. He was arrested June 5 after two guests at the party realized the dog had belonged to Lisa and Bill Sampson, who live across the street from Aquino. He was arraigned in Town Court June 9 and released on bail.
